The consequences of being convicted of a DUI can vary from a term of informal probation to commitment in a California State Prison. Being well informed and properly represented can have a profound effect on how to move forward with your case.

One factor which may affect the outcome of a DUI case is the county in which the DUI charges are filed. Prosecution positions can vary from county to county. The same facts in some courts can result in excellent results, less so with others.

With a majority of DUI cases, no custody or jail is imposed by the court. In cases involving prior convictions, however, it is common for sentences to include custody. We have been successful in most cases in avoiding actual custody. Some courts routinely allow custody to be served in a house arrest or weekend work program, thereby avoiding actual jail time. In Los Angeles County in particular, jails are overpopulated and are forced to release non-violent offenders far before their scheduled release date. Though attorneys have no control over the early release of an inmate, my experience is that DUI inmates, as non violent offenders, tend to be released earlier.

The number of prior arrests and or conviction for DUI or other alcohol related charges in the past ten years will have the greatest effect on your exposure to actual custody.
