Many individuals are charged with DUI based on arrests not for bad driving, but for bad luck! Officers set up these checkpoints to randomly check whether drivers are impaired. Many view these checkpoints as a clear intrusion on citizens' Fourth Amendment rights against illegal search and seizure. The specific case law governing the legality of checkpoints is set forth in the case of Ingersoll v. Palmer (1987) 43 Cal.3d 1321, which suggested that a warrantless sobriety checkpoint seizure can overcome Fourth Amendment protections through an administrative search.

 1) Decisions regarding the administration of the checkpoint must be determined by law enforcement supervisors, not field officers.

2) Officers should have limited discretion and preset boundaries.

3) Safety conditions must be maintained.

4) Checkpoints must be situated in a reasonable location.
